Agreement to Terms

By accessing or using the services provided by Keylight Digital, LLC ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our services.

Description of Services

Keylight Digital provides software-as-a-service (SaaS) products for freelancers and independent professionals, including ProfitTracker. Our current offerings and pricing are described on our homepage. Some features are available on a free plan; paid plans unlock additional functionality. We reserve the right to modify, suspend, or discontinue any part of our services at any time with reasonable notice.

Account Terms

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the security of your account credentials.
• You are responsible for all activity that occurs under your account.
• You must be at least 16 years of age to use our services.
• You may not use our services for any illegal or unauthorized purpose.

Payment Terms

• All prices are listed in United States Dollars (USD).
• Subscriptions are billed on a recurring basis (monthly or annually, depending on your selected plan).
• Payment is processed securely through Stripe. By subscribing, you authorize us to charge your payment method on each billing cycle.
• Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date.
• We reserve the right to change pricing with at least 30 days' notice. Price changes will take effect at the start of your next billing cycle.
• If payment fails, we may suspend access to your account until the outstanding balance is resolved.

Cancellation

You may cancel your subscription at any time by contacting us at support@keylightdigital.dev. Upon cancellation:

• You will retain access to the service through the end of your current billing period.
• No further charges will be made after cancellation takes effect.

Acceptable Use

You agree not to:

• Violate any applicable laws or regulations.
• Interfere with or disrupt the integrity or performance of our services.
• Attempt to gain unauthorized access to our systems or other users' accounts.
• Use our services to transmit malware or other harmful content.
• Resell, sublicense, or redistribute our services without written permission.

Intellectual Property

All content, features, and functionality of our services — including software, text, graphics, logos, and design — are owned by Keylight Digital, LLC and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our services without our prior written consent.

You retain ownership of any data you upload or create using our services. By using our services, you grant us a limited license to use your data solely to provide and improve the services.

Limitation of Liability

To the maximum extent permitted by law, Keylight Digital, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or in connection with your use of our services.

Our total liability for any claim arising from these Terms or your use of our services shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

Disclaimer of Warranties

Our services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that our services will be uninterrupted, error-free, or secure.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts located in Washington.

Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page with a revised "Last updated" date. Continued use of our services after changes are posted constitutes acceptance of the updated Terms.
